NPO

The Department of Finance recently released draft legislation to implement its proposal to increase the number of non-profit organizations (that are not registered charities) that are required to file an annual information return. While some non-profit organizations are already required to file a T1044, the current rules only capture those organizations with total assets that exceed $200,000 or that have passive income over $10,000.

In summary, the broader proposals as currently drafted would require:

  • Any non-profit organization that received more than $100,000 in a fiscal period to file the T1044
  • Other non-profit organizations that do not meet this threshold will be required to file a short-form information return

If you have any questions about whether your non-profit organization is currently required to file a T1044 or about the proposed changes, please contact one of our lawyers to assist.
